Terms of Service (ToS)

1. TERMS OF SERVICE

1.1. General Terms

Travelosophy is a brand of Travelosophy LLC, a leading incoming tour operator in the United States, building on over 10 years of valuable experience in the travel market. Our registered head office is at 30 N Gould St Ste R, Sheridan, 82801 Wyoming (USA).

Before making a reservation at Travelosophy (via any of our sales channels, e.g. our own website, other platforms, or via direct agreement), we encourage you to read these Terms and Conditions carefully, as they constitute a contract agreement between Travelosophy and you from the time the booking is made. The person who makes the booking accepts these conditions on behalf of all the people in the group and is responsible for all payments due.

By submitting a booking or accepting a booking proposal upon request (and after accepting our estimate), you confirm to us that you comply with these arrangements. These terms can be modified at any time in case of necessity without the necessity to inform you.

1.2. Booking and Payments

Once you have submitted your booking or accepted our proposals, you will receive a confirmation and pro-forma invoice of your booking via e-mail. Please note that all bookings require payment of 20% of the total package price at the time of the booking or by the date provided by Travelosophy and accepted upon agreement. If the total price is less than $/€/£ 1000, or booking occurs less than 30 days before your arrival date, full payment is required.

1.3. Confirmation

Most of the bookings are confirmed instantly; however, packages that include overnight accommodation and car rental may take a bit longer. One of our sales representatives will contact you within two business days (48 hours) to re-confirm the booking.

The travel documents will be delivered to you once the full payment has been received. You will receive your travel documents: e-tickets, vouchers and itinerary via email.

Please print out these documents, as you will need to show them for all services during your tour.

If by any chance our travel consultant is unable to obtain confirmation (if car rental/or accommodation is not available) an alternative will be offered. If you do not accept the alternative or Travelosophy is not able to offer you an alternative, you are entitled to cancel with a full refund of the deposit.

Booking services with Travelosophy are available only to persons aged 18 years and older. By submitting a booking, you warrant and confirm to us that you comply with these arrangements. Should you travel with children, please contact us before booking for travel arrangements.

2. TERMS OF PAYMENT

2.1. Payment after booking

Please note that all online bookings require payment of 20% of the total package price at the time of the booking. If the total price is less than $/€/£ 1000 or booking occurs less than 30 days before your arrival date full payment is required.

You will be informed by e-mail when you need to pay the balance of your booking which is 30 days before your departure date.

We accept all major credit cards: Visa, MasterCard and American Express. There is no service fee for processing Visa or MasterCard payments.

If you prefer to pay for your booking with a bank transfer, please follow the details from the previous paragraph, at 1.2. We accept bank transfer in USD $, EUR € and GPB £. Should you pay with a different currency, in order to avoid extra bank fees, please contact us for support (we can arrange payment in different currencies for your convenience).

All prices quoted on Travelosophy are in USD $ and per person, unless otherwise specified. All refunds are due in the same currency of the payment. Travelosophy is not responsible for any changes in currency exchange rates that might occur from the time of booking until a refund is made.

3. VALIDITY OF PRICES

3.1. Estimates and rates

All rates quoted or shown in our tariffs are based on current prices. All prices mentioned include value- added tax (VAT). Travelosophy reserves the right to alter or change already published prices on the website and other platforms without notice in the event of currency fluctuation, government taxes, or any such costs increases that is outside Travelosophy’s control.

Estimates are valid 30 days after issue and however till the date indicated on them and cannot be considered as the final price to pay. Only invoices represent the amount due for the booking.

Prices are guaranteed against any surcharge after an invoice has been issued, unless the increase is due to government laws or currency changes and amounts to 5% of the package price or more. The amounts that exceed 5% will be charged and clients will be entitled to cancel their booking with a full refund if the surcharge exceeds 10%.

Any increase due to changes in government laws, i.e. tax changes, fuel crisis, or significant increase over 5% of our costs, will be added to the invoice.

3.2. Inclusions

All our prices and the final costs include only what is expressively described as included in the final tour plan and the specific service, if included (e.g. transportation, guide). In case of lodging, the price includes the specific treatment described (e.g. BB, HB, FB); in any case, no extra costs (e.g. room service, tips, hotel city taxes) are included. Personal expenses, tips, and all is not expressively indicated as included cannot be considered included.

3.3. Changes and cancellation

If a specific day tour/activity is cancelled due to circumstances outside our control, e.g. weather warnings, volcanic activities, or minimum numbers are not reached, we will propose the best alternative. If an alternative is not doable, Travelosophy will refund the money you have paid for that specific day tour. Travelosophy shall then have no further liability towards you.

Travelosophy reserves the right to alter routes, itineraries or departure times without prior notice should this be necessary due to weather or other reasons that are beyond Travelosophy‘s control.

Please notice that in the case of changes of flights, the passenger is responsible for any additional costs that become payable as a result of such changes.

4. CANCELLATION TERMS

4.1. General terms

Applied cancellation fees differ between packages (including accommodation and/or car rental) and day tours.

4.2. Cancellation of full bookings/packages

For cancellations received up to 30 calendar days before the scheduled departure, a 20% cancellation fee will be charged.

For cancellations received 15 – 29 calendar days before the scheduled departure date a 60% cancellation fee will be charged.

For cancellations received 7 – 14 calendar days before the scheduled departure date a 80% cancellation fee will be charged.

For cancellations received within 7 calendar days before the scheduled departure date a 100% cancellation fee will be charged.

4.3. Cancellation of day-tours/activities

For cancellations received at least 7 calendar days before the scheduled departure there is no cancellation fee.

For cancellations received 3 – 6 calendar days before the scheduled departure a 50% cancellation fee will be charged.

For cancellations received within 2 calendar days before the scheduled departure a 100% cancellation fee will be charged.

If you need to make a change to your holiday arrangement you must send us a notification via email at least 4 weeks before departure. Some suppliers frequently charge fees for changes; if this occurs, the extra fee will be added to your total.

5. CAR RENTAL TERMS AND CONDITIONS

5.1. General Terms

Travelosophy cooperates with the best and most reliable car rental suppliers. Together we provide comprehensive car rental brokering services offering the best available prices, security and the best service in the market. You can be sure that the cars you rent through our service will be in excellent condition.

5.2. Age Requirements and Driving License

The minimum driver’s age for car rentals depends on the rental destination country. The driver must present a valid driver’s license held for a minimum of one year at the time of rental. An International

Driving Permit (IDP) / International Driving License (IDL) is also required if your national driver’s license is not in Roman script. This is recommended for translation purposes and may only be used in conjunction with a national driving license. The person named on the reservation must be the main driver, who must be present at time of rental and the payer of any rental charges

5.3. Additional fees

An Airport Service Charge applying to all rentals with pick-up and drop-off at Catania International Airport is included in all our prices. All drop off fee’s due to one way rentals are paid on location, contact us for more information on this. All rates are subject to a Government tax (VAT), which is included in all our rates. Our car rates do not include petrol. The rental car will normally have a full tank of fuel and the car should be refilled before returning it. All rates are based on a rental period of 24 consecutive hours. If a rental exceeds the 24 hour period an extra day will be charged.

5.4. Insurance

Third party liability is equivalent to the amount stipulated by law at any given time. This also applies to the amount of individual driver liability. Third party cover and personal accident insurance is automatically included in your rental. Collision Damage Waiver (CDW) insurance is included in our prices.

5.5. Credit Cards

A credit card in the main driver’s name is required for renting the vehicle even when a voucher covers the cost of the rental. Cash and/or debit card deposits will not be accepted. The credit card imprint may be used to pay all extra charges, including extra driven kilometers, extra insurance, parking fines, damages or any costs due to the car rental company as a result of the hire’s use of the car. Acceptable credit cards are: American Express, MasterCard and Visa. At the time of rental, an authorization is obtained on your credit card based on the estimated rental charges. There must be sufficient credit on your card to cover all charges. If you don’t have sufficient credit, you could make a bank transfer, so please contact us before booking.

6. LIABILITY 6.1. General Terms

Once you book at Travelosophy, via the website, other platforms, or upon direct agreement, you agree to be legally bound by the following terms. Travelosophy acts in good faith and cannot be held responsible for any loss, damage, accidents, sickness or schedule changes caused by weather or road conditions, force majeure such as natural catastrophes, strikes or any other irregularities beyond the control of Travelosophy. Luggage is at the owner’s risk throughout the tour. We therefore advise all clients to have insurance cover, as clients are at their own risk on optional tours, such as hiking tours, riding tours, rafting, kayaking, skiing, etc.

All information on Travelosophy is subject to change and we reserve the right to correct any mistakes that may appear on our website. These general booking conditions are subject to change and we reserve the right to update these conditions without notice.

6.2. Complaints

Our main goal is to provide you with an excellent service. If you, for any reason, are not satisfied with your holiday package, we would like to hear about it. We recommend you contact us as soon as any incident occurs. All complaints must reach Travelosophy within 7 days after your tour terminates. Otherwise, any possible compensation entitlement will not be valid.

7. INSURANCE

7.1. General Terms

Please note that individual travel insurance is not included in the tour price and all medical costs and other costs involved must be paid by the client. It is therefore strongly recommended that participants take out personal insurance, especially for the active tours and excursions. We strongly recommend to all of our clients to purchase comprehensive travel insurance prior to departure to meet any contingencies, in case of flight delay, lost luggage, medical treatments, injuries, etc.

7.2. Travelosophy Insurance

Please note that Travelosophy is covered by its own liability insurance in case of direct damage caused by Travelosophy, and not for all the cases that are out of Travelosophy’s direct control. Travelosophy only and not the travelers is covered by the liability and professional insurance, issued by Hiscox.

7.3. Travel Insurance

As tour operator, we have special agreements with insurers operating all over the world, which issue travel policies for the specific duration of the tour and for the specific number of participants at reduced costs.
